7. How to place an order
To place an order, you must follow the online purchase procedure and click on “Buy now.” Then, you will receive an email acknowledging receipt of your order (the “Order Confirmation”). Once the item leaves our facilities, you will be informed by email that it is being shipped (the “Shipping Confirmation”).
8. Prices
The published prices are expressed in euros and include VAT.
In any case, offers will be properly marked and identified as such, clearly indicating the previous price and the offer price, as well as the duration period.
At Pagani Design there is no mandatory minimum purchase.
9. Payment methods
Goods must be paid in advance via PayPal, credit/debit card, or Klarna.
Credit/debit card.
Payment accepts VISA, MasterCard, Amex cards and is made at the time of completing the purchase; this method is convenient and secure. Payment is processed through the secure Redsys payment gateway. Proximise LLC never has access to your card's confidential data.
PayPal
If you want, you can also pay for your purchase with the PayPal payment system. With this method, you can also pay by credit card without needing to register with PayPal.
Klarna
You can also request to pay in installments through the platform Klarna. See terms.
If you wish to receive the invoice in electronic format, you can reply to the purchase confirmation email with the word "Factura" and it will be sent automatically.

10. Delivery times and methods
All shipments are insured and sent by courier. Shipping will be made the next business day after payment is received, except if the item is out of stock, in which case we will inform you of the expected delay.
The shipping cost will be added automatically before payment. Prices, depending on destination, are as follows:
Orders under €50:
- €4.99 by courier to Spain.
- €4.99 by courier to European Union countries.
- €4.99 by courier to the rest of the world.
Orders over €50:
- Free by courier to Spain.
- Free by courier to European Union countries.
- Free by courier to the rest of the world.

Delivery times:
- Peninsula: 7 business days
- Balearic Islands: 14 business days
- Canary Islands, Ceuta, and Melilla: 14 business days.
- European Union: 7-10 business days
- Rest of the world: 7-14 business days.
Goods requiring different delivery times will reflect this particularity in their description. The item will only be shipped once payment has been received.
In case of package loss, Proximise LLC guarantees a full refund of the money paid.
11. Warranty
Proximise LLC guarantees the authenticity of the goods marketed and undertakes to deliver the contracted goods to the user, covering a 3-year warranty.
In case of defective goods, Proximise LLC will proceed, as appropriate, with repair, replacement, price reduction, or contract termination, procedures that will be free of charge for the user.
Repair and replacement will be free of charge. This free service will include the necessary expenses incurred to remedy the non-conformity of the goods with the contract, especially shipping costs, as well as costs related to labor and materials.
Proximise LLC is responsible for non-conformities that appear within three years from delivery, which will be considered made on the date shown on the invoice or purchase receipt, or on the delivery note if this is later. Unless proven otherwise, it will be presumed that non-conformities that appear within two years after delivery of the goods already existed when they were delivered.
Damage due to incorrect use or handling of the goods, or wear caused by normal use, is not included in this warranty.
12. Right of withdrawal
The User is granted the right of withdrawal from the purchase made through the website www.paganidesignes.com, being able to return the goods, if not satisfied, within a maximum period of fourteen (14) calendar days from the date of receipt of the goods.
The right of withdrawal shall not apply to contracts relating to the supply of goods made according to the consumer's and user's specifications or clearly personalized. (art. 103 of Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws).
The refund will be made within 14 calendar days from the date on which the decision to withdraw from the contract has been effectively and unequivocally communicated. The amount to be refunded will be the total paid by the user, including normal shipping costs and excluding surcharges for urgent shipments. The refund will be made by the same payment method used for the purchase, unless the user has expressly arranged otherwise and provided that the user does not incur any expense as a result of the refund.
The user must return the goods without undue delay and, in any case, no later than 14 calendar days from the date on which the user has communicated their right of withdrawal. The deadline is considered met if the goods are delivered before the deadline has expired.
Shipping costs generated by the return of goods will be borne by the user.
Returned goods must be in good condition, and their value may be reduced if the user handles them differently than necessary to establish the nature, characteristics, and functioning of the goods, as well as if the goods are not returned in their original packaging.

Although its use is not mandatory. If you fill out the form, you must send it through the postal or electronic address indicated in it. The user may also request it via the email info@paganidesignes.com or any other means that allows proof of their decision, indicating the good or goods they wish to return. We will promptly notify you by email of the receipt of such withdrawal.
13. Complaints and Claims

Likewise, you can also request information about the goods offered or contracted through our website.
When a claim submitted directly by the consumer to the seller cannot be resolved, according to current regulations, the business must provide the consumer with information regarding whether it is affiliated with an alternative consumer dispute resolution entity or if it is obliged by a rule or code of conduct to participate in the procedure before a specific entity. Therefore, below in these Terms of Contracting, we provide you with the data on how you can properly channel your claim.
14. Right of exclusion
Proximise LLC reserves the right to deny or withdraw access to the portal and/or the services offered without prior notice, on its own initiative or that of a third party, to users who violate the portal's Terms of Use.
Proximise LLC will pursue breaches of the portal's Terms of Use, as well as any misuse of its portal by exercising all civil and criminal actions that may correspond to it under the law.
14. Modifications and links
Proximise LLC is not responsible for the misuse of the contents of its website, being the sole responsibility of the person who accesses or uses them.

16. Applicable law and competent jurisdiction

Likewise, in compliance with the provisions of the Alternative Dispute Resolution Law, we inform consumers that, as an affiliated entity and under the terms of the Code of Conduct, users may turn to Confianza Online for the alternative resolution of any disputes (https://www.confianzaonline.es/como-reclamar/formulario-de-reclamaciones/). If these relate to electronic transactions with consumers, or data protection when related to this area, claims will be resolved by the Confianza Online Mediation Committee, accredited for alternative dispute resolution in consumer matters.
